General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed through the online shop of WAYA Drinks (hereinafter «WAYA»). By placing an order, the customer agrees to these GTC. Deviating terms of the customer apply only if WAYA confirms them in writing.
2. Provider
WAYA Drinks
Zaunstrasse 11
8750 Glarus
Schweiz
E-Mail: info@waya-drinks.com
3. Conclusion of Contract
The presentation of products in the shop does not constitute a binding offer, but rather an invitation to place an order. By submitting the order via the «Order with obligation to pay» button, the customer makes a binding offer. The contract is concluded upon our confirmation (confirmation e-mail or delivery).
4. Prices
All prices are stated in Swiss francs (CHF) and are final prices including statutory value added tax (reduced rate of 2.6 % for non-alcoholic beverages); the VAT included is shown during checkout. For business customers with individually agreed terms, net prices plus VAT apply. The price displayed in the shop at the time of ordering is decisive. Shipping costs are shown separately before completion of the order.
5. Shipping and Delivery
Shipping costs amount to CHF 15.– per started case of 24 (e.g. up to 24 cans CHF 15.–, 25–48 cans CHF 30.–). Shipping costs do not apply for pickup at the location.
We deliver within Switzerland and to Liechtenstein. Delivery times are indicative and not binding; a minor overrun or shortfall does not entitle the customer to withdraw from the contract. If a product is unavailable, we will inform the customer and refund any payments already made.
6. Payment Terms
Payment is made, at the customer's choice, by invoice (payable within 30 days of the invoice date), by TWINT or – for pickup – in cash. In the event of default of payment, WAYA is entitled to charge default interest as well as reasonable reminder fees. WAYA may make delivery conditional upon advance payment.
7. Retention of Title
The delivered goods remain the property of WAYA until full payment has been made.
8. Warranty / Defects
The statutory warranty provisions of the Swiss Code of Obligations (CO) apply. The customer must inspect the goods upon receipt and report obvious defects immediately, at the latest within 7 days, in writing (e.g. by e-mail). In the case of a justified notice of defect, we will, at our discretion, provide a replacement or refund the purchase price.
9. Return and Exchange
For online orders within Switzerland, there is no statutory right of withdrawal or return. For reasons of food hygiene, the exchange or return of flawless foodstuffs is excluded. This does not affect the statutory rights in the case of defective goods (see clause 8).
10. Liability
WAYA is not liable for slight negligence. Liability for indirect damages, consequential damages and lost profit is excluded to the extent permitted by law. Liability for auxiliary persons is excluded to the extent permitted by law. Mandatory statutory liability – in particular under the Product Liability Act – remains reserved.
11. Data Protection
The processing of personal data is governed by our Privacy Policy.
12. Applicable Law and Place of Jurisdiction
Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is – to the extent permitted by law – Glarus, Switzerland.
13. Final Provisions
Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. WAYA reserves the right to amend these GTC at any time. The version valid at the time of the order is decisive.
